John Eastman, the lawyer who helped Donald Trump try to overthrow the 2020 election, spent a very long time remaining loyal to Trump. Eastman spent forever fighting in court to try to avoid having to hand over emails that incriminate himself and Trump. But even as a judge was ruling that at least some of the emails must be turned over, some of them leaked to the media, revealing just how guilty Eastman is of election tampering and more.

Now that Eastman is unable to save himself, he’s made a rather bizarre move. Last night he made a court filing which urged the judge not to give the emails in question to investigators. But in his filing, Eastman argued that the emails shouldn’t be turned over because Trump was so directly involved in Eastman’s plot to overthrow the election. Wait, what?

This doesn’t sound like it could possibly be correct, but it is. Eastman is revealing that Trump participated in the overthrow plot by writing out two different strategy notes by hand. All that this does is directly incriminate Trump. Investigators will now demand these handwritten notes, or in their absence, investigators will demand that Eastman testify about their contents.

Eastman has to know that his last minute request for suppression of the emails has zero chance of working, or even delaying things; that ship has already sailed. So what is Eastman doing with this filing? He’s throwing Trump to the wolves here. But is it because Eastman has incoherently lost his marbles? Or is this Eastman’s way of letting investigators know that he has the goods on Trump and is willing to make a deal?

We’ll see. John Eastman’s behavior has been bizarre all along. All this time he really seemed to want to protect Donald Trump, either out of misguided personal loyalty, or because protecting Trump meant protecting himself. But now that his long running bid to suppress the incriminating emails has finally failed, even the looniest of loyalists can reach a point where they decide they’re not actually willing to rot in prison for their boss. Stay tuned. If Eastman isn’t trying to cut a deal, then he’s incoherently unraveling in real time, which could also prove enlightening.
