When the DOJ waited until nearly midnight eastern time last night before releasing its forty page filing about why Donald Trump’s request for a Special Master should be denied, it wasn’t just about making Trump sweat it out. It was about making sure Trump had as little time as possible to respond. While the DOJ’s deadline was midnight last night, Trump’s deadline is 8pm tonight.
That’s right, Trump and his troubled legal team – some of whom have been implicated in the filing – must now figure out how to quickly put together a coherent response to this mammoth DOJ filing. To that we say good luck.
This DOJ filing makes clear that it has Trump nailed to the wall, legally speaking. It would be near impossible to put together any kind of rebuttal filing, even if Trump had all the time in the world (which he doesn’t), and even if his attorneys were the best in the world (which they’re not).
Keep in mind that while this DOJ filing is officially about Trump’s request for a Special Master, it’s unofficially serving as an opportunity for the DOJ to let the public know just how guilty Trump is, without having to do something like holding a press conference. Merrick Garland and his team are winning this battle without even having to speak. All they had to do was respond to Trump’s BS court request. And now he only has nine hours to come with something – anything – he can file of his own, before the judge presumably hands him his backside tomorrow.
