The House has already impeached Donald Trump once, and while Senate Republicans corruptly refused to remove him, the process at least served to educate the public about Trump’s crimes. Of course Trump has committed dozens if not hundreds of impeachable offenses, raising the question of whether the House should impeach him again before the election.

Even while that debate plays out, the House revealed today in a Supreme Court filing that it’s at least open to the possibility of impeaching Donald Trump again. The House Judiciary Committee is making the argument that it needs to see the Mueller grand jury evidence so it can decide whether to impeach Trump over it.

Keep in mind that this is just a legal argument; it doesn’t necessarily mean that the House will impeach Trump again, even if it obtains the secret Mueller materials, and even if they’re roughly as damning as we all suspect they are. There would still be almost zero chance the Republican Senate would remove Trump, particularly this close to the election. And impeaching Trump a second time clearly wouldn’t cause him to rein in his crime spree, because impeaching him the first time didn’t cause him to rein it in either.

So it’s a tough call, and we’ll just have to trust that Speaker Nancy Pelosi gets it right, which she generally does. We suspect that for Pelosi to do it, the grand jury material would have to be so overwhelmingly devastating to Trump that it could prompt Senate Republicans to panic and selfishly oust him, in the name of trying to save their own seats in November, before she’d go through with a second impeachment. But now it’s official that the House is at least open to impeaching Donald Trump a second time, which is certainly interesting.
