Donald Trump’s legal team has a whole new problem

In addition to being the worst president in United States history, Donald Trump also has perhaps the worst legal team in history. His gang of attorneys, most of whom aren’t even technically his attorneys, have botched his defense on such an unbelievable level that there’s almost no precedent for it. Now it turns out Trump’s lawyers have a whole new problem on their hands, and one which it doesn’t appear they’ll be able to solve.

When the “president” has committed treason in order to rig the election and steal the presidency, his legal defense gets a bit tricky. Because so much classified information was involved in his crime spree, his attorneys need to be able to view that classified intel and discuss it with their client. That means the lawyers need security clearance. Trump’s attorney John Dowd had been granted clearance to review the evidence, but he was the only one, and he quit awhile ago.

There is currently no one on Donald Trump’s legal team with security clearance. Jay Sekulow has been trying from the start, but for whatever reason, he hasn’t been able to pass the required background check. Trump’s new “attorney” Rudy Giuliani is one of his own criminal co-conspirators, so there’s no chance he’ll be given any sort of clearance. At this point Giuliani probably couldn’t pass a background check to get a job as a security guard, let alone the kind that would allow him to view classified information.

Donald Trump’s other new attorney Emmet Flood appears to have a respectable enough history to pass a background check. But because Trump stashed Flood on the White House payroll, Trump and Flood have no attorney-client privilege. So even if Flood does obtain security clearance and takes a look at the classified evidence in the Trump case, there are severe limits to what he’d be able to discuss with Trump. It’s not just that Trump’s legal team is failing at the job; they’re not even in position to try to do the job.
