Just how poorly did things go for Donald Trump on Tuesday? After he made a social media post about his trial judge’s clerk, the judge was so outraged that he issued a gag order on the spot – and then he later cleared the courtroom of everyone but Trump and his lawyers, in order to send a message to them.

Of course Trump already officially lost this trial before it began, thanks to a summary judgment. But depending on how badly Trump screws up this trial, he could end up with even more severe financial penalties than he otherwise would have. Trump appears to be figuring out that he’s made a terrible mistake with his approach.

Of course Trump is merely whining about how badly this is going for him, instead of trying anything approaching a strategy. He declared on social media on Tuesday night that “It is so unfair that I am being tried under Section 63(12) … It is a Consumer Protection Statute.” That’s not accurate, of course. But the key takeaway here is that any time someone is complaining about how “unfair” something is, it means they’re losing – and they have no idea how to change the fact that they’re losing.
