I’ve said all along that no one should get too excited about the prospect of Donald Trump being removed from the 2024 ballot, because the battle was always going to end up in front of the U.S. Supreme Court, and you really just never know what those clowns are going to do. They’ve shown no interest in helping Trump with his criminal troubles, but they could easily rule that he must remain on the ballot. Or could they?

It’s important to understand that the Supreme Court can rule any way it wants on anything, no matter how egregious or corrupt or at odds with the Constitution such a ruling might be. There aren’t the votes to remove any of them under impeachment, there’s no recourse, it sucks, and that’s that. But this Supreme Court, in spite of being corrupt and unhinged, does sometimes rule correctly – seemingly only because it couldn’t find an excuse to rule incorrectly.

So it’s worth noting that according to new research from The Messenger, the courts have already clearly and repeatedly established that January 6th was an insurrection incited by Donald Trump. So if the Supreme Court does want to side with Trump on this, it would be almost impossible for it do so by claiming that Trump didn’t incite an insurrection. Instead the Supreme Court would basically have to admit that Trump incited an insurrection, but then latch onto some (real or imagined) technicality while ruling in Trump’s favor.

And maybe, just maybe, this could be enough to prompt the Supreme Court to say screw it, we’re just going to rule against Trump on this one. We’ve already seen this Supreme Court rule correctly on things like racial gerrymandering, while ruling egregiously incorrectly on abortion. It really seems to come down to what this Supreme Court thinks it can get away with in the court of public opinion – and even then there’s little consistency. Good luck to the Supreme Court on this one. If they get this one wrong, it could result in the strongest push yet for Supreme Court expansion.
