New York Attorney General Letitia James has recent subpoenaed Donald Trump, Donald Trump Jr, and Ivanka Trump in her civil probe into Trump Organization financial corruption. The move has gotten big headlines because the Trump family is collectively trying to fight the subpoenas in court. But a major aspect of this development is being largely overlooked.

While the New York AG is technically investigating the Trump Organization itself, the company is owned and operated by Trump family members – so they’re the de facto targets. As a rule of thumb, the targets are the last people whose testimony you seek, and only after the investigation is basically already complete.

Legal expert Tristan Snell, who used to work in the New York Attorney General’s office, tweeted this take: “This means the case is 95-99% done. The AG’s office typically only subpoenas targets to testify when an investigation is mostly complete — the testimony is icing.”

We’re inclined to agree. The New York Attorney General just tipped off that civil probe into the Trump Organization is basically complete. Now the Trump family has to decide whether to testify in the Trump Organization’s defense and risk unwittingly saying something that can be used in New York’s parallel criminal probe into Donald Trump, or refuse to testify and have that be used as a basis for concluding that the Trump Organization is indeed culpable – which could result in a forced shutdown and asset forfeitures.
