Today’s January 6th Committee public hearing was utterly devastating in terms of proving Donald Trump’s criminal guilt in relation to the Capitol attack. Then at the very end, the committee added a kicker that could make it a lot easier for Trump to end up indicted and convicted.

Committee vice chair Liz Cheney announced today that, after the previous public hearing, Donald Trump personally called a potential witness. The witness refused to answer, and instead reported the phone call to the committee, who has also put it in the hands of the Department of Justice. Notably, Cheney said that this is a witness we have not heard from yet, meaning it’s not Cassidy Hutchinson and apparently not Pat Cipollone. This is tantamount to felony witness tampering. Even so much as making an attempt to speak to a witness against you is considered felony tampering, even if the witness refuses to engage with you.

So who is this mystery witness? We don’t know. But the committee did say that we will hear testimony from this witness during a public hearing next week. We’re about to find out. And whether or not the DOJ thinks it can get charges like seditious conspiracy to stick to Donald Trump, the DOJ loves bringing charges on process crimes like tampering and obstruction, because it’s easier to get a conviction.
