There has been so much conflicting and confusing reporting today about which Brett Kavanaugh allegations the FBI is allowed to investigate, it’s no longer even clear whether Donald Trump or Don McGahn is the de facto President of the United States right now. This has led Senator Dianne Feinstein to use her influential position on the Senate Judiciary Committee to go after McGahn tonight.

Dianne Feinstein has sent a letter to Don McGahn, and to FBI Director Christopher Wray, demanding a copy of the written directive that the White House gave the FBI with regard to the Brett Kavanaugh investigation. Despite being the ranking member on the Senate Judiciary Committee, Feinstein does not have subpoena power in her own right. Chairman Chuck Grassley does have subpoena power, but he has not co-signed the letter, meaning that he refused to get involved. But Feinstein can still get pretty far on this rather quickly.

If Don McGahn is truly as out of control right now as some major news outlets are suggesting, he might decide to simply ignore Feinstein’s letter. But there is far greater reason to expect that FBI Director Christopher Wray is willing to comply. Although Wray is a Trump appointee, he’s shown no willingness to do Donald Trump’s bidding in the Trump-Russia investigation. Instead he appears to be a straight shooter. He may feel compelled to turn the letter over to Feinstein tomorrow morning, for the sake of propriety.

So we’ll see where this goes next. But as even more controversy and chaos arises with regard to the FBI investigation into Brett Kavanaugh, the more it’ll create public outrage, which will make it even more of a problem for Donald Trump. He’s already revealed that he understands this controversy is problematic for him when he tweeted last night that the FBI could do whatever it wanted. Even as we all continue trying to figure out what’s really going on, Dianne Feinstein may have figured out how to use Wray to blow the whole thing open.
