Even as it becomes more clear that the DOJ is likely to end up criminally indicting Donald Trump on some unknown timeline, there has remained the strong possibility that Fulton County Georgia District Attorney Fani Willis would end up indicting Trump before the Feds do. It looks like those odds just got a lot higher.

DA Willis just subpoenaed a number of Donald Trump’s top henchmen, including Rudy Giuliani, John Eastman, and Lindsey Graham, according to the Atlanta Journal Constitution newspaper. Why weren’t these subpoenas issued sooner? Any criminal probe of this type has to start at the bottom and keep working its way to the top, in order to uncover the reluctant testimony of lower level witnesses, which it can then use to corner the highest level witnesses into giving up the kingpin.

For this grand jury to be reaching the state where it’s subpoenaing the very uppermost hostile witnesses in the entire criminal conspiracy, it points to the probe being in a highly advanced stage. And while congressional subpoenas can be dragged out in court and are only enforceable via the long process of a contempt indictment, grand jury subpoenas are subject to swift enforcement by the court system – meaning they can’t realistically be dodged.

It’s not only notable who’s on this list of subpoena recipients, but who’s not on the list. Because people can’t be forced to testify against themselves to a grand jury, prosecutors will often subpoena those individuals who are seen as witnesses, and not necessarily criminal targets. In other words, Willis could be planning to use the testimony of Giuliani and Graham to nail Trump – and only nail those individuals as a fallback if they refuse to testify against Trump.

But Mark Meadows, who was reportedly a crucial participant in Trump’s Georgia election criminal plot, is missing from the AJC’s subpoena list. Is Fani Willis saving him for last? Does this mean she intends to indict Meadows alongside Trump? Is it possible that Meadows has recently flipped? He did just get caught committing federal witness tampering. If Meadows has now realized he’s toast, and has decided to cut a deal with the DOJ, he could also be cooperating with DA Willis. If Meadows isn’t cooperating, it looks like he’s going down in Georgia, in addition to going down federally.
