Several days ago former Trump Department of Justice official Jeffrey Clark – the guy who helped Donald Trump craft a strategy for trying to overthrow the 2020 election results – agreed to testify to the January 6th Committee. Sure enough, he showed up today, but by all accounts he invoked imaginary privilege and refused to answer important questions.

This has to be seen as a panic move on Clark’s part. If he thought he had any real privilege standing, he’d have invoked it as an excuse not to show up. But the Steve Bannon criminal referral must have made Clark too afraid not to show up, for fear of ending up as Bannon’s cellmate. So he showed up and then stupidly tried to get himself off the hook with fake privilege.

Now Clark is going to end up being referred to the DOJ for prosecution for contempt of Congress, and he’ll likely end up doing time. In the process, Clark appears to have given something away. He’d rather risk the short prison sentence that comes with contempt, than risk the longer prison sentence he could end up facing if he testifies and confesses to his role in the insurrection. No way this ends well for Clark, unless he quickly changes his mind and cuts a plea deal against Donald Trump and others.
