When Donald Trump issued a last minute pardon for his longtime henchman Steve Bannon, Palmer Report pointed out that Bannon would very likely end up in prison anyway. For one thing, preemptive pardons are legally flimsy to begin with, and Bannon’s pardon in particular was written poorly. That’s before getting to the fact that Bannon was only pardoned on federal charges.

Now the Manhattan District Attorney is looking at bringing state charges against Steve Bannon for the specific crimes that Trump pardoned him on, according to the Washington Post. A few things stand out here. First, this is the same District Attorney who has a widely documented grand jury in the process of criminally indicting Donald Trump, so it’s not surprising that he’s looking to go after Bannon as well.

Second, even if New York steps in with state charges against the specific crimes that Steve Bannon was pardoned on, the DOJ can still push forward with federal criminal charges for any crimes that Bannon either wasn’t pardoned for, or wasn’t properly pardoned for.

In addition, pardons don’t cover crimes that are committed after you’re pardoned. Bannon is a career criminal, so it seems a given that he’s committed even more crimes since he was pardoned – and the Feds have surely been watching him like a hawk since his initial arrest. In other words, Bannon will surely end up in prison one way or the other.
