Earlier this week House Minority Leader Kevin McCarthy openly threatened to legislatively retaliate against the telecom companies if they comply with January 6th Committee subpoenas for the phone records of insurrectionist House Republicans. We wondered why McCarthy was making a threat he couldn’t carry out, and exposing himself to potential felony obstruction of justice charges, by making such a move. Now we know.

Kevin McCarthy is in fact one of the House Republicans whose phone records are being subpoenaed by the committee, according to a new report this evening from CNN. This is a big deal, for a couple reasons.

First, it’ll undercut everything that McCarthy will attempt to say or do regarding the committee, but now everyone is going to know that he’s a target in the January 6th probe. Second, it means that the committee has solid evidence to support the notion that McCarthy’s January 6th phone records will lead back to Donald Trump. That means this is about to get really ugly for Trump, McCarthy, and the Republicans.

It also points to the strong possibility that the January 6th Committee could end up subpoenaing Kevin McCarthy to publicly testify about his communications with Donald Trump regarding the insurrection. McCarthy could try to fight such a subpoena, but that would be a confession on his part, and it could be the end of him politically. But if he goes ahead and testifies, he could expose himself to eventual criminal conspiracy charges. No wonder McCarthy has been panicking.
