Last night Palmer Report explained just how big of a deal it is that Colonel Vindman has testified that White House lawyer John Eisenberg suggested moving the Trump-Ukraine phone call transcript to a secret classified server. If Vindman’s testimony bears out, it means that – on some level – Eisenberg was in on the plot to hide evidence in the name of protecting Donald Trump.

This means Eisenberg can risk going to prison for obstruction of justice after Donald Trump is gone, or he can give helpful testimony to the House impeachment inquiry about the secret server and then hope his cooperation is enough to save him from being indicted later. Now it turns out we’re about to find out very soon which way Eisenberg is leaning on this.

John Eisenberg is formally scheduled to testify to the House impeachment inquiry this Monday, November 4th. Of course there’s a chance he won’t show, considering his testimony could end up incriminating him. That said, if Eisenberg doesn’t show, he’ll be allowing other witnesses like Vindman to tell the story without his input.

We’ll see what happens here. Notably, two different federal judges are holding hearings today on whether two other impeachment witnesses, Charles Kupperman and Don McGahn, have to show up and testify. If either of these judges makes a definitive ruling today, that would set a precedent for other witnesses, and it could impact Eisenberg’s thinking when it comes to his scheduled Monday testimony. Eisenberg’s status is worth watching over the weekend.
